Florida education officials are preparing to require every public school district and charter school governing board to formally address artificial intelligence within their internet-safety policies—placing student privacy, responsible use and parental oversight at the center of the conversation.

🔹 The Florida Department of Education is proposing a rule directing all district school boards and charter school governing boards to incorporate specific AI guidelines into their existing internet-safety policies.
🔹 State officials are scheduled to discuss the proposed change during a public workshop on August 5.
🔹 Under the current draft, districts and charter schools would have until January 1, 2027, to adopt and implement the required AI policies.
🔹 The initiative is closely connected to the Family Educational Rights and Privacy Act, commonly known as FERPA, and Florida laws protecting confidential student information.
🔹 Florida already limits how operators of websites, applications and online services used for K–12 education may collect, use, disclose or monetize student information.
🔹 Protected information can include biometric data, disabilities, socioeconomic information, food purchases, political affiliations, religious information, text messages, documents and student identifiers.
🔹 The protections also extend to online search activity, photographs, voice recordings and geolocation information—data that could potentially be entered into, captured by or analyzed through AI platforms.
🔹 The proposed rule would also require schools to notify parents when AI instructional tools are approved, explain how students will interact with them and provide options for parental consent and non-AI alternatives.
🔹 The draft addresses academic integrity, teacher training, transparency, student-data protections and the need for AI to supplement rather than replace professional judgment.
🔹 The proposed Florida school AI rules arrive as students and teachers increasingly use generative AI for research, writing, tutoring, lesson development and classroom administration.
🔹 Earlier this year, the Florida Senate passed versions of a broader AI Bill of Rights during both the regular and special legislative sessions, but each measure ultimately died in the House.
🔹 That proposal would have required parental consent and given parents greater control over their children’s accounts and interactions with AI companion chatbots.
🔹 It also introduced restrictions on using AI-generated versions of a person’s name, image or likeness for commercial or advertising purposes without consent.
🔹 The legislation also sought to prevent state agencies from contracting with certain AI companies connected to countries designated as foreign concerns.

Artificial intelligence is entering classrooms faster than many school policies can adapt. While these tools can personalize instruction, strengthen academic support and prepare students for an AI-driven economy, they can also collect highly sensitive information with limited visibility into where that data is stored or how it may be used.
Clear rules will help schools distinguish productive educational use from practices that could compromise student privacy, academic integrity or personal safety.
Districts will need guidance covering approved platforms, acceptable classroom use, parental consent, teacher responsibilities and the handling of confidential student information.
For Florida schools, this is not simply a technology-policy update. It represents an important shift toward treating AI literacy, data protection and responsible digital citizenship as essential components of modern education.
The strongest policies will protect students without preventing them from learning how to use one of the most consequential technologies shaping their future.
