⚖️ AI Evidence in Florida Courts: When Seeing Is No Longer Believing

A photograph can tell a story. AI can now invent the photograph.

A recent Florida Today column raises a troubling question: are courts prepared for fabricated videos, recordings, and messages that look like genuine evidence? The concern surrounding AI evidence in Florida courts reaches beyond lawyers submitting invented legal citations. It involves material that could influence someone’s freedom, finances, or access to their children. Investigating suspected fakes can require forensic experts—and money that some defendants do not have.

Florida has safeguards. State law already requires sufficient evidence that an item is what its presenter claims. And a Florida Supreme Court rule that took effect June 15, 2026, requires people signing court filings to confirm that cited legal authorities exist and are accurately cited. But checking a legal citation and detecting a manufactured recording are different tasks. That rule does not establish a new system for identifying deepfakes.

⭐ Why AI Evidence in Florida Courts Matters

Justice depends on the ability to distinguish a convincing accusation from a supported one. As fabrication becomes easier, verifying where evidence came from becomes more important. There is another danger, too: genuine evidence may be dismissed as fake simply because fakes are possible. Courts must guard against both mistakes without making the truth affordable only to those who can hire an expert.

❓ The Big Question

When evidence can be manufactured, how do we keep justice grounded in what actually happened?
